Effective date: 12 October 2026
Last updated: 12 October 2026
Welcome to Blouvis Trading. These Terms of Service govern access to and use of our website, products, services and online store. By accessing our website or placing an order, you agree to these Terms, subject to applicable South African law.
Please read these Terms carefully before using our website or purchasing any products.
1. Business Information
Blouvis Trading is operated by:
2. General Conditions
By using this website, you confirm that you are legally capable of entering into a binding agreement under South African law.
You agree not to use our products, services or website for unlawful purposes or in a manner that infringes the rights of Blouvis Trading or any third party.
We reserve the right to refuse service, restrict access or cancel orders where legally justified, including in cases of suspected fraud, abuse or unlawful activity. Such actions will not unlawfully limit any consumer rights.
3. Online Store Terms and Orders
All orders placed through our website are subject to product availability, payment verification and acceptance by Blouvis Trading.
Product descriptions, specifications, images and prices are provided to help customers make informed purchasing decisions. Reasonable differences in colour or appearance may occur because of screen settings or supplier variations.
Customers are responsible for providing accurate contact, billing and delivery information.
An order confirmation acknowledges receipt of an order and does not necessarily constitute final acceptance where further verification is required. We will communicate any rejection or cancellation and arrange any refund due in accordance with applicable law.
We will provide the information required by the Electronic Communications and Transactions Act 25 of 2002 (ECTA), including applicable product details, total prices, delivery information, payment methods and return terms.
4. Pricing, Payments and Taxes
All prices will be displayed in South African Rand (ZAR), unless expressly stated otherwise.
Prices and applicable delivery charges, taxes and additional fees will be disclosed before the customer completes the purchase.
Payments must be made using the payment methods offered on our website. Orders may be withheld from dispatch until payment has been successfully verified.
If a pricing or payment error occurs, we will take reasonable steps to notify the affected customer and resolve the matter lawfully. We will not rely on a pricing error clause to avoid obligations that cannot legally be excluded.
Where an order is cancelled and a refund is due, the refund will be processed in accordance with applicable law and the relevant payment provider's procedures.
5. Delivery and Risk
Delivery estimates will be communicated during checkout or in subsequent order communications.
We will take reasonable steps to dispatch and deliver orders within the agreed period. If no different period is agreed, the applicable statutory requirements will apply.
If an item becomes unavailable after an order is placed, we will notify the customer and provide any refund required by law.
Responsibility for loss or damage during delivery will be determined in accordance with applicable law. Nothing in these Terms transfers risks or responsibilities to consumers where doing so would be unlawful.
6. Returns, Exchanges, Refunds and Consumer Rights
Blouvis Trading respects consumers' rights under the Consumer Protection Act 68 of 2008 (CPA), ECTA and other applicable legislation.
Customers may qualify for returns, repairs, replacements or refunds in circumstances prescribed by law, including where goods are defective, unsafe, not reasonably suitable for their intended purpose or otherwise fail to comply with applicable consumer protections.
Certain qualifying online transactions may also be cancelled under ECTA's seven-day cooling-off provisions. These provisions have specific exclusions and conditions, which will apply to the relevant transaction.
Customers must contact us at info@blouvistrading.co.za with their order number and details of the issue. We will explain the applicable return procedure and any lawful requirements concerning the condition or return of the goods.
Nothing in this policy excludes or reduces a consumer's mandatory statutory rights. Our detailed Returns and Refunds Policy, available at www.blouvistrading.co.za, forms part of these Terms.
7. Personal Information and POPIA
Blouvis Trading processes personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and applicable data-protection laws.
We may collect and process personal information such as names, contact details, delivery addresses, order records and relevant transaction information for purposes including:
We will process personal information for lawful, specific and legitimate purposes, limit collection to what is reasonably necessary, and take appropriate measures to protect information against unauthorised access, loss or misuse.
Information may be shared with payment processors, delivery providers, technology service providers and other authorised parties where necessary and lawful. Cross-border transfers, where applicable, will be handled in accordance with POPIA.
Customers may exercise applicable rights to access, correct or delete personal information, object to certain processing, withdraw consent where processing is based on consent, and lodge complaints with the Information Regulator, subject to applicable law.
For privacy enquiries, contact our Information Officer at info@blouvistrading.co.za.
Our separate Privacy Policy, available at www.blouvistrading.co.za, explains our information processing practices in greater detail.
8. Errors, Inaccuracies and Omissions
We make reasonable efforts to ensure that website content, prices, descriptions, promotions and other information are accurate.
Occasionally, information may contain typographical errors, inaccuracies or omissions. We reserve the right to correct such errors, update information and amend website content where appropriate.
Where an error affects an existing order or a consumer's rights, we will address the matter in accordance with applicable law. We will not use this clause to avoid valid contractual or statutory obligations.
9. User Comments and Feedback
Customers may submit reviews, comments, suggestions and other feedback, provided the content is lawful and respectful.
By submitting content, you confirm that you have the necessary rights to share it and that it does not infringe another person's intellectual property, privacy or other legal rights.
You grant Blouvis Trading a non-exclusive, royalty-free licence to use, reproduce, display and publish submitted content for legitimate business purposes, subject to applicable law and any relevant privacy rights.
We may moderate or remove content that is unlawful, misleading, defamatory, abusive, discriminatory, fraudulent, spam-related or otherwise inappropriate.
We are not obliged to publish every submission. Personal information included in comments will be handled in accordance with our Privacy Policy and applicable law.
10. Prohibited Uses
You may not use this website or its content to:
We may take proportionate action against prohibited conduct, including restricting access or reporting suspected unlawful activity to the relevant authorities where appropriate.
11. Intellectual Property
Unless otherwise stated, the website's content, branding, logos, text, graphics, images and design are owned by or licensed to Blouvis Trading and are protected by applicable intellectual property laws.
You may access and use this content for personal, lawful and non-commercial purposes. You may not reproduce, distribute, modify or commercially exploit it without prior written permission, except where permitted by law.
Nothing in these Terms transfers ownership of intellectual property to a website user.
12. Third-Party Links and Services
Our website may contain links to third-party websites, payment platforms or external services.
These third parties operate independently and may have their own terms and privacy policies. We are not responsible for their content, security or practices to the extent permitted by law.
The inclusion of a link does not necessarily constitute an endorsement of the linked service.
13. Disclaimer of Warranties
We endeavour to maintain a reliable, secure and accessible website. However, we cannot guarantee uninterrupted availability, error-free operation or the complete absence of technical issues.
To the extent permitted by law, the website is provided subject to its availability and operational limitations.
Nothing in this clause excludes statutory warranties, consumer protections, representations or guarantees that cannot lawfully be excluded or restricted.
14. Limitation of Liability
To the maximum extent permitted by applicable law, Blouvis Trading will not be liable for losses that are not legally attributable to our acts or omissions or that cannot reasonably be anticipated in the circumstances.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability for gross negligence where it cannot lawfully be excluded, fraud, or the infringement of mandatory consumer rights.
Any limitation of liability will be interpreted narrowly and consistently with the CPA, ECTA and other applicable legislation.
15. Indemnification
To the extent permitted by law, you agree to indemnify Blouvis Trading against reasonable losses, damages, costs and expenses arising directly from your unlawful conduct, fraud, wilful misconduct or material breach of these Terms.
This clause does not require you to indemnify Blouvis Trading for its own unlawful conduct, negligence where liability cannot legally be excluded, or any matter for which an indemnity would be prohibited by law.
16. Suspension and Termination
We may suspend or terminate your access to the website where reasonably necessary because of unlawful activity, fraud, security risks or a material breach of these Terms.
Where appropriate and legally permissible, we will provide notice and an opportunity to remedy the breach.
Termination does not remove rights or obligations that accrued before termination, nor does it cancel any statutory consumer rights or valid refund claims.
17. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be limited or severed to the minimum extent necessary.
The remaining provisions will continue to apply, provided they can operate lawfully and consistently with the parties' rights.
18. Entire Agreement and Amendments
These Terms, together with our Privacy Policy, Returns and Refunds Policy and any applicable product-specific terms, constitute the agreement governing your use of the website and relevant transactions.
Where applicable, mandatory legal protections and valid transaction specific agreements will prevail over inconsistent provisions.
We may update these Terms from time to time. The latest version and its effective date will be published on our website.
Changes will apply prospectively where appropriate and will not retrospectively remove accrued rights or unlawfully alter an existing agreement.
19. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of South Africa.
The parties will endeavour to resolve disputes through good-faith communication. Where a dispute cannot be resolved directly, either party may pursue the remedies available under South African law, including referral to a competent court or an appropriate consumer protection or dispute resolution body.
Nothing in these Terms prevents a consumer from exercising a statutory complaint, referral or dispute-resolution right.
